Regarding medical attention, do not ignore a head injury. If you have concussion symptoms (eg., headache, dizziness, nausea, loss of memory or appetite), see attention from a doctor. Either an emergency room or Immediatecare/UrgentCare are appropriate. Other injuries to extremities, neck, or back may require examination. Please call your doctor if you have not done so already.

 

Regarding a police report, it is helpful to have the police record and document the information of those involved. This will help with the report to the respective insurance company and any claims that may be made at a later date. The police report will detail the date, time, and location of the collision, summarize the facts, and assign fault. If there is no police report, you should file your own MV104. Taking photographs of the scene and vehicle involved using your cell phone is extremely helpful.

 

New York is a no-fault state: the operator’s car insurance will be obligated to pay your medical bills and wage loss in most cases. Identify the carrier and make a claim with that carrier. Do not use your own health insurance if the driver has a valid automobile insurance policy. If you own a car, you may wish to report the incident to your own carrier as well. Check your policy for coverage details.

 

Get witness names, addresses, and phone numbers in case there is a dispute about how the collision occurred.
