In 2019, Governor Andrew Cuomo signed the Child Victims Act into law, which opened doors for past or current victims of sexual abuse in their adolescence to take action against their perpetrators. Prior to this historic signing, those who suffered from child sexual abuse were limited by strict confines for when they could bring claims forth. Now, past or present victims have the ability to fight for the justice that has eluded them. 

These cases may involve those who were abused by school personnel, members of clergy, family members, or any other individuals or group entities. This involves anyone who was either directly involved in the act of abuse or who allowed the abuse to occur.

New Legislation/Qualifications

• Lengthens period of time during which alleged abusers may be held accountable for their crimes
• Permits victims to enact a civil lawsuit against the accused any time before they are 55
• Allows those with time-barred claims to receive a one-year window to commence action against their perpetrator 
• Removes the need to file a notice of claim for any sexual offenses/abuses inflicted upon a minor
• Mandates judicial training in regard to any crimes pertaining to child sexual abuse
• Authorizes the Office of Court Administration to announce all rules and qualifications to ensure that victims are aware of their opportunity for revived action
